§ 110.23 LICENSE PROCEDURE.
   (A)   Individuals.
      (1)   New applicants. A person desiring a license from the city must file with the City Administrator/Clerk-Treasurer a verified written application on a form provided by the city and include the information required by the Commissioner of Public Safety. Every application for a new license shall include the following information:
         (a)   Name and age of the applicant;
         (b)   The exact street address or legal description of the premises where the licensed business is to be conducted;
         (c)   The name or names of all persons owning or having an interest in and the extent of the interest in the licensed business, including their ages, occupations, residence addresses and place of business;
         (d)   A list of all leases or subleases of the premises where alcohol is to be sold;
         (e)   A list of all alcohol businesses in which the applicant has an interest in and the extent of the interest; and
         (f)   Any other information deemed necessary by the city.
      (2)   Applicants renewing a license. Applicants that are renewing a license are required to provide the information listed in divisions (A)(1)(a), (A)(1)(b), (A)(1)(c) and (A)(1)(f) above only.
   (B)   Partnerships; corporations.
      (1)   New applicants. If the applicant is a corporation or partnership, the applicant must supply the information listed in division (A)(1) above for the manager of the licensed premises and must also list the name and general purpose of the corporation or partnership and the state under which it is incorporated or organized. The following information is also required:
         (a)   The names and addresses of all partners if a partnership and the names of all officers, directors and stockholders, and their addresses if a corporation;
         (b)   Each individual’s interest in the license and the extent of the interest;
         (c)   The name or names of the individual or individuals having the controlling interest in the corporation or partnership; and
         (d)   The name of any municipality in the state in which the applicant has held or presently holds a license for the sale of alcohol.
      (2)   Partnerships and corporations renewing a license. Partnerships and corporations that are renewing a license are required to provide the information listed in division (A)(2) above and are not required to provide the information set forth in division (B)(1) above; provided that, no information that is required in division (B)(1) above has changed since the previous application. If any of the information has changed, the applicant shall provide this information in its renewal application.
      (3)   Notification of change. If, at any time during the term of a license held by a corporation or partnership, the manager of the licensed premises is changed, the licensee must promptly notify the City Administrator/Clerk-Treasurer and submit the information required by division (A)(1) above on the new manager.
   (C)   Financial responsibility. Prior to the issuance of a license, the applicant must file with the City Administrator/Clerk-Treasurer satisfactory evidence of adequate financial responsibility in the amount of the insurance coverage and subject to the conditions specified in M.S. § 340A.409, as it may be amended from time to time. This proof must be filed with the city and the Commissioner of Public Safety. Any liability insurance policy filed as proof of financial responsibility under this division (C) shall conform to M.S. § 340A.409, as it may be amended from time to time. The city must be named as an additional insured on the insurance policies. If the event is to be held on city-owned property or right-of-way, the license holder shall sign an agreement to hold the city harmless and indemnify and defend the city for acts of the license holder. Operation of a business licensed under this section without having in effect, and having evidence on file with the city of, the financial responsibility required by this division (C) is grounds for revocation or suspension of the license.
