The licensee shall establish written procedures for receiving, acting upon, and resolving subscriber complaints. Such written procedures shall prescribe the manner in which a subscriber may submit a complaint either orally or in writing to the licensee. A copy of these procedures shall be provided to all subscribers upon application for service as required pursuant to § 42.0543. The procedures shall also inform the subscriber of the subscriber’s right to file a complaint with the department in the event the subscriber is dissatisfied with the licensee’s action. No proceedings to resolve subscriber complaints shall be undertaken by the Department until the licensee’s complaint resolution procedures have been exhausted.
