(b) Structures registered in the California Register of Historical Resources or other State or Federal government registers or official inventories are exempt from this Section in accordance with §§ 18954 and 18955 of the California State Historical Building Code.
(c) A roof covering installed prior to January 1, 2009, with fire retardant treated wood or other organic material with a Class A rated assembly, under a permit from the County’s Building and Safety Division and supporting documentation showing date of installation, is allowed if the roof covering is inspected and approved in writing as to its condition by the Fire Chief or the Fire Chief’s designee. The inspection will also include a review of the property by the Fire Chief or the Fire Chief’s designee for compliance with County Code § 23.0301. If inspected and approved in writing by the Fire Chief or the Fire Chief’s designee, the requirements of County Code § 82.13.050(p)(4) are held in abeyance 25 years past the final inspection approval date identified on the County’s Building and Safety Division construction permit for the roof covering or when the warranty of the roof covering has expired, whichever comes first.
(d) Notwithstanding Subdivision (c) and except as provided in Subdivision (b), all construction, addition, alteration, repair, moving, conversions and/or change of occupancy that causes a change in more than ten percent of the existing total roof area or in at least 200 square feet of the existing total roof area, whichever is smaller, of buildings and/or structures within the Fire Safety Overlay as defined in § 82.13.030 of the County Code and mapped on the Fire Hazard Overlay Maps of the County General Plan, shall, as to the entire roof structure, be brought into and/or shall be in compliance with County Code § 82.13.050(p)(4). If any of the provisions of the California Building Code, as adopted by the County Code, are in conflict with the provisions in this Section or § 82.13.050(p)(4) of the County Code, the more restrictive in terms of fire/ember resistance shall apply.
(e) Properties failing to meet the standards identified in this Section shall be deemed not in compliance and, as such, property owners are subject to available enforcement actions identified in §§ 11.0201 et seq. of the County Code, including, but not limited to, civil, administrative citation, and/or criminal actions, as well as the recordation of a notice of pendency or a notice of action.
