Definitions herein shall supplement all definitions throughout the California Health and Safety Code and elsewhere in State laws and regulations pertaining to hazardous materials, hazardous waste and toxics control.
CERTIFIED UNIFIED PROGRAM AGENCY or CUPA. The San Bernardino County Fire Department, Division of Hazardous Materials as the agency defined in Code of Regulations §§ 15110 et seq., that has been certified by the Secretary of the California Environmental Protection Agency to implement the Unified Program specified in Health and Safety Code §§ 25404 et seq.
CHIEF. The San Bernardino County Fire Chief or Fire Marshal.
CODE. The San Bernardino County Code.
CONTINGENCY PLAN. A document setting out an organized, planned and coordinated course of action in case of fire, explosion or release of hazardous waste or hazardous waste constituents to air, soil, or surface water that could threaten human health and safety or the environment. Such document shall be consistent with Code of Regulations §§ 66265.50 et seq.
CORRECTIVE ACTION. Activities taken to investigate, characterize, evaluate, correct and enforce requirements applicable to address releases of a hazardous waste, hazardous constituents or hazardous substances, as necessary to protect public health and the environment.
CUPA PERMIT. A permit issued pursuant to Health and Safety Code §§ 25404 et seq.
CUPA PERMIT PROGRAM ELEMENTS. The following six elements that are further defined in Chapter 7 of Division 3 of Title 2 of this Code:
(1) Hazardous waste generators and hazardous waste on-site treatment;
(2) Underground storage tanks (UST);
(3) Hazardous material release response plans and inventories;
(4) California Accidental Release Prevention (CalARP) Program;
(5) Above ground storage tanks (spill prevention control and countermeasure plan only);
(6) Uniform Fire Code Hazardous Material Management Plans and Inventories.
DEPARTMENT. The San Bernardino County Fire Department.
DISPOSAL. Any of the following:
(1) The discharge, deposit, injection, dumping, spilling, leaking, placing, pouring or venting of any hazardous waste or material so that the hazardous waste or material or any constituent of the hazardous waste or material is or may be emitted into the air or discharged into or onto any land or waters, including groundwater, or may otherwise enter the environment.
(2) The abandonment of any hazardous waste or material.
DIVISION. The Division of Hazardous Materials of the San Bernardino County Fire Department.
HAZARDOUS SUBSTANCE. A substance that presents a threat to the public because of its toxicity, radioactivity, flammability, or other characteristic dangerous to the public health or the environment. It shall also include all hazardous substances so defined by Health and Safety Code § 25501(p).
INVESTIGATIVE OFFICER and DEPUTY INVESTIGATIVE OFFICER. Any employee or agent of the San Bernardino County Fire Department, Hazardous Materials Division, who is so designated by the Chief, or who is registered as a Registered Environmental Health Specialist (R.E.H.S.) in the State of California.
LOCAL PUBLIC OFFICER. The County Fire Chief or Fire Marshal.
OPERATOR. Any person or entity engaged in any activity or facility that is subject to the Division’s jurisdiction.
OWNER. Any person or entity having a financial interest in any activity or facility that is subject to the Division’s jurisdiction.
PERSON. Includes individuals, businesses, general partnerships, limited partnerships, joint ventures, corporations, State and local governmental entities, the U.S. Government and its agencies, and every other legal entity or any association having legal obligations subject to the provisions of this Code.
