(A) Violation of § 19.23.005 of this chapter shall be considered a misdemeanor offense, and individuals arrested for the violation shall be issued a citation in accordance with Cal. Penal Code § 853.6(a).
(B) Upon conviction of any misdemeanor offense, the punishment shall be administered in accordance with applicable provisions of the Penal Code. Cal. Penal Code § 19 provides in part that misdemeanor offenses are “punishable by imprisonment in the county jail not exceeding six months, or by fine not exceeding $1,000, or both”.
