(A) Definitions. For the purposes of this article, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
AUTHORIZED OFFICER. Any employee of the Bureau of Land Management to whom has been delegated the authority to perform the duties described in this division.
PUBLIC LANDS. Any lands and interest in lands owned by the United States within San Benito County, and administered by the Secretary of the Interior through the Bureau of Land Management, without regard to how the United States acquired ownership, except any land held for the benefit of Indians;
(B) Unlawful acts. Unless permitted in writing by the Authorized Officer, it is prohibited on the public lands to:
(1) Resist or interfere with the efforts of firefighter(s) to extinguish a fire;
(2) Enter an area which is closed by a fire prevention order; or
(3) Perform any act restricted by a fire prevention order.
(C) A violation of this section is a "wobblette", in that any person violating this section may be cited or charged with either a misdemeanor or an infraction. Criminal fines shall not exceed $1,000 for a misdemeanor, or $250 for an infraction, in addition to any court imposed fees and assessments.
(D) A violation of this section may also be enforced through the issuance of administrative citations as set forth in the San Benito County Code.
(E) Any violation of this section may be enforced by a federal or state law enforcement or peace officer, as well as any county enforcing officers.
