§ 11.12.009 SUSPENSION OF PRACTITIONER REGISTRATION.
   (A)   An individual’s registration may be suspended for just cause, as set forth in division (B) below, upon a finding by the Local Enforcement Agency, after notice and opportunity to be heard, that:
      (1)   After the registration was issued it was determined that the application for the registration is incomplete or inaccurate; or
      (2)   The individual has violated this chapter or any federal or state related law.
   (B)   The time period for suspension of registration shall be based on the following criteria:
      (1)   Upon the first time that the LEA makes the finding that either (A)(1) or (A)(2) exist, the registration shall be suspended for up to 30 days.
      (2)   Upon the second time that the LEA makes the finding set forth in division (A)(1) and (A)(2) within 12 months of the first determination, the registration shall be suspended for up to 90 days.
      (3)   Upon the third and each subsequent time that the LEA makes the finding set forth in division (A)(1) and (A)(2) within 12 months of the prior determination, the registration shall be suspended for up to one year.
   (C)   The decision of the LEA may be appealed to the Director of Health and Human Services or his or her designee.
