This chapter shall not apply to head lettuce which is exempt under the provisions of California Administrative Code, Title 3, § 1390; provided, however, that a valid permit for such exemption has been issued by the Agricultural Commissioner pursuant to California Administrative Code, Title 3, § 1390.1, unless such a permit is not required pursuant to Cal. Food and Agricultural Code § 43332.
