Pursuant to and as provided in Cal. Welfare and Institutions Code § 17403.1, Assembly Bill 1149, Statutes of 1983, the County of San Benito elects to be exempted from the mandatory obligation to pay representation fees out of the county’s lien claim for reimbursement in specified actions in federal court concerning applicants for or recipients of the state supplementary program which provides cash assistance to aged, blind and disabled persons, with the offset against a county’s claim to be no more than 25% of the interim assistance reimbursement received by the county. However, the county shall retain the authority to pay representation fees in such instances as the county may deem appropriate. Any such payment shall be subject to approval by the Board of Supervisors.
