(A) The purpose of this chapter is to assist in protecting consumers who purchase goods in the city by requiring that all itinerant merchants and vendors, as defined in § 113.02 of this chapter, register with the Clerk before commencing business within the city. In addition, it is the policy of the city to promote the protection of the public health and safety, and to promote the economic base and general welfare of the community by the regulation of off-site itinerant merchants and vendors operating inside the city.
(B) Reasonable regulation of off-site itinerant merchant or vendors is necessary to ensure that any stand or structure design and construction for purpose of off-site vending is safe, orderly and harmonious with the appearance and character of the neighborhood and the city, and provides for safe and adequate pedestrian and vehicular traffic.
(C) Reasonable regulation of off-site itinerant merchants or vendors is necessary to protect and conserve the economic base of the community, including property values.
(D) The regulations contained in this chapter are not intended to prohibit or hamper speech which is protected by the first amendment, but merely to regulate specific activities which are commercial in nature.
