In case any animal sold pursuant to the provisions of this subchapter be sold for more than is sufficient to pay the fees and charges aforesaid, such excess shall, by the officer or his or her assistant making the sale, be deposited with the Clerk, who shall pay such excess, under an order of the City Council, to the owner of such animal or animals or to the person entitled to the possession of the same upon claim and proper proof within one year from date of the sale.
