905.02 DEPOSIT REQUIRED PRIOR TO EXCAVATION; BOND.
   (a)    The permit shall be granted by the Director of Public Service when there has been deposited with him by the applicant a sum equal to double the estimated cost of restoring the street to its proper condition. In no case less than five dollars ($5.00) shall be deposited. The deposit shall be paid into the street repair fund, to be held to secure the proper reconstruction and repair of the work done under the permit. Permits may be issued for necessary excavation in dirt roads and unpaved public grounds without requiring the deposit of any sum, at the discretion of the Director. Permits may also be issued without deposits under the provision of subsection (b) hereof.
   (b)    Any person may furnish a bond, approved by the Director both as to amount and surety, conditioned upon faithful compliance with the conditions of this section which shall pay on demand the cost and expense of refilling and repaving all excavations taken up under permits issued to the person without the cash deposit mentioned in subsection (a) hereof, during the life of the bond. The bond may be revoked or additional sureties or an additional bond may be required by the Director at any time.
