§ 150.07 DESIGN SPECIFICATIONS; STANDARDS.
The Council may, by resolution, adopt special design specifications for the construction, repair, or replacement of sidewalks under this chapter. Such special design specifications may be adopted from time to time and for such area within the village as the Council shall reasonably determine. The Council shall base its determination upon the comparative cost and the public purpose to be served in achieving a safe, harmonious, and integrated plan for side walk construction, repair, and development for the area involved. The Council also reserves the right to grant variances from any such special design specifications. As used herein, VARIANCE shall have the same meaning as set forth in § 154.003. Variances may only be granted upon written application of an affected party filed with the Clerk of Council. Such applications shall be in the form prescribed by the Council, and the Council shall grant or deny applications within 30 days from the date of filing. Failure of the Council to grant or deny applications within the time specified shall be considered a denial of such applications. The Street Commissioner shall maintain records of the applications filed and the disposition made of each, all of which shall be certified to him or her by the Clerk of Council.
