§ 51.01 PRIVATE DISPOSITION OF GARBAGE, RUBBISH.
   (A)   Garbage cans. It shall be the duty of each householder or commercial establishment in, or upon, premises within the village where garbage or rubbish is created or allowed to be, to procure and keep available for the exclusive use of such premises, or the part thereof, occupied by the householder or commercial establishment, a metal or plastic garbage can or cans of not less than ten gallons or more than 30 gallons’ capacity, and airtight to hold the garbage created or accumulated thereon for a period of no more than two weeks pending its removal. Such can or cans shall also be watertight, shall have closed lids, and shall be provided for each one with a bail or two handles on opposite sides of the same. It, or they, shall be placed on the ground level of the premises at a place easily accessible to, and for, the garbage collector, but not within the limits of a street or other public place. Any garbage created or accumulated upon said householder’s premises or commercial establishments shall be placed in such can or cans by the householder.
   (B)   Garbage and rubbish. All garbage and rubbish shall be placed in containers, as prescribed; provided that tree brush and bush trimmings intended for removal shall be tied in bundles not to exceed 48 inches by 18 inches by 18 inches in dimension.
   (C)   Disposal except at landfill area. It shall be unlawful to dispose of, bury, burn, or dump within the limits of the village, or within 5,000 feet thereof, any garbage or rubbish created within or without the village. In the interest of public health and sanitation, all existing dumping placed within the village are hereby declared a nuisance and ordered closed. All garbage and rubbish shall be conveyed to the site of the village dump and disposed of there.
   (D)   Compliance.
      (1)   It shall be unlawful for any householder in the village to keep, place, or deposit garbage or rubbish on any grounds or premises whatsoever, except in the manner designated in division (E) below.
      (2)   It shall be unlawful for any householder, or any other person in the village, to throw or deposit any garbage, rubbish, or waste matter, or to cause the same to be thrown or deposited upon any street, way, lane, or other public place, or upon any vacant lot, or where rats, mice, fowl, dogs, cats, birds, or other living things can feed thereon. Each day’s violation of the provisions of this division (D) or division (E) below may be treated as a separate and distinct offense of this section.
   (E)   Unlawful to keep longer then between collections. It shall be unlawful for any householder or person to keep garbage or rubbish upon his or her premises for more than two weeks.
