1-2-1: REPEAL OF GENERAL ORDINANCES:
   A.   Prior Ordinances: All general ordinances of the city passed prior to the adoption of this code are hereby repealed, except such as are included in this code or are by necessary implication herein reserved from repeal (subject to the saving clauses contained in the following sections), and excluding the following ordinances which are not hereby repealed: tax levy ordinances; appropriation ordinances; ordinances relating to boundaries and annexations; franchise ordinances and other ordinances granting special rights to persons or corporations; contract ordinances and ordinances authorizing the execution of a contract or the issuance of warrants; salary ordinances; ordinances establishing, naming or vacating streets, alleys or other public places; improvement ordinances; bond ordinances; ordinances relating to elections; ordinances relating to the transfer or acceptance of real estate by or from the city; and all special ordinances.    B.   Continuations; Conflicting Ordinances: The ordinances in this code, so far as their provisions are substantially the same as those of previously existing ordinances, must be construed as continuations thereof, and not as new enactments; any ordinances previously adopted in conflict with the ordinances set out herein are repealed, subject to the provisions of Idaho Code 50-905.    C.   Effect Of Repeal: The repeal of ordinances as provided in subsection B of this section shall not affect any right which has accrued, any duty imposed, any penalty incurred, nor any action or proceeding commenced under or by virtue of the ordinances repealed, nor the tenure of office of any person holding office at the time when they take effect; nor shall the repeal of any ordinance thereby have the effect of reviving any ordinance heretofore repealed or superseded.
