4-5-4: AUTHORIZED USE AND REVIEW:
   A.   Authorization of Installation: Only the Mayor and the City Clerk or a designee authorized by the Mayor or the City Clerk and approved by the City Council, will be involved in, or have access to surveillance camera data unless otherwise specifically ordered by the City Council (“Authorized Personnel”)
   B.   Ethics and Training: Video monitoring for security purposes will be conducted in a professional, ethical and legal manner. Authorized Personnel involved in active video monitoring will be trained and supervised in the responsible use of this technology.
   C.   Not a Personnel Monitoring Tool: In general, the City will not permit either the installation or use of cameras as a tool to monitor routine performance or the use of personal “webcam” or similar technology for surveillance purposes unless specifically ordered by the City Council pursuant to a condition of a personnel action.
   D.   No Placebo Camera Placement: The placement and use of dummy or placebo cameras is prohibited.
   E.   Authorized Image Review: When an incident is suspected to have occurred, only Authorized Personnel may review the images from surveillance camera data.
   F.   Surveillance Images Copying: Only the Mayor, the City Clerk or the City Council may authorize copies of surveillance images.
   G.   Requests: All requests to release of surveillance records must be authorized by the Mayor or the City Clerk pursuant to a property public records request.
   H.   Release of Video Images: The Mayor and City Clerk have the responsibility to evaluate and make decisions for the release of Recordings based on the following request source criteria:
      1.   For legitimate investigative, safety and security reasons;
      2.   Law Enforcement agencies, where it is believed that the images will assist in a legal inquiry;
      3.   Prosecuting agencies;
      4.   Legal Representatives via a subpoena;
      5.   The media, where a decision has been made that it is needed in order to assist in the identification of victim(s), perpetrator(s) or witnesses in relation to a criminal incident;
      6.   Otherwise required by law. (Ord. 2021-750, 10-12-2021)
