A. Established: A planning and zoning commission is established in and for the city.
B. Composition: The commission shall consist of five (5) members, including at least one member who shall reside within the city impact area pursuant to Idaho Code 67-6526. All members must have resided in the county for at least two (2) years immediately preceding appointment to the commission. The area of impact member(s) must have resided in the city or the area of impact for at least two (2) years immediately preceding appointment to the commission and must reside within the area of impact while serving on the commission. All other members must have resided in the city for two (2) years immediately preceding appointment to the commission, and must reside within the city while serving on the commission.
C. Appointment: Members shall be appointed by the mayor and confirmed by the city council.
D. Compensation: Compensation for members shall consist of reimbursement for travel outside the limits of the city while on commission business at a given rate per mile compensatory with city council policy.
E. Term: Two (2) members of the commission shall be appointed to serve terms of three (3) years and three (3) commission members shall be appointed to serve terms of four (4) years, with terms expiring on September 30. The city council may, by resolution, designate or assign a three (3) year term or a four (4) year term for each commission seat.
F. Vacancies: Vacancies in the commission shall be filled in the same manner as the original appointments.
G. Removal: Members may be removed for cause by a majority vote of the governing board.
H. Power To Incur Indebtedness: Neither the commission nor any member thereof shall incur any financial liability in the name of the city except as authorized by the mayor and city council. (1977 Code §§ 2.32.030, 2.32.050, 2.32.070, 2.32.140; amd. Ord. 2016-710, 7-24-2016; Ord. 2022-757, 6-20-2022)
