9-6-2: APPLICABILITY:
   A.   The provisions set forth in this section for the lot line adjustment shall be applicable for the consolidation of lots by removing or otherwise adjusting a common lot line affecting two (2) or more adjoining parcels of land under the following circumstances:
      1.   The owner(s) of two (2) or more of the adjoining lots elect to remove or adjust the lot lines between the adjoining parcels;
      2.   The owner(s) have complied with the filing requirements set forth below;
      3.   Any easements that become unnecessary as a result of combination of parcels may need to be vacated. A request to vacate any such easements must be made concurrently with the application for lot line adjustment;
      4.   New easements shall be established as appropriate;
      5.   No additional lots may be created by the lot line adjustment;
      6.   Parcels resulting from these procedures meet the minimum lot size requirements for the zone in which the lots are located and otherwise comply with all City zoning and development requirements. However, if the original lots are not conforming or do not meet all City zoning and development requirements, this requirement can be waived by the City upon a showing by the applicant that it is not feasible. Alternatively, the City may grant a request to adjust a lot line if the resulting lots will not comply with all City zoning and development requirements if a building restriction is concurrently placed on the lot(s);
      7.   The lot line adjustment shall not change the orientation of the existing blocks or the City streets and alleys unless the applicant can show that allowing a change in orientation is in conformance with the surrounding platting pattern and surrounding streets;
      8.   Prior to approval of an application for lot line adjustment, the applicant shall pay any outstanding property taxes and provide proof that there are no delinquent property taxes, special assessments, interests, or City utility fees due on the parcels of land which the lot line adjustment application relates.
