§ 150.36 SIDEWALK REIMBURSEMENT PROGRAM.
   (A)   Voluntary residential sidewalk reimbursement. Effective October 1, 2014, the village will reimburse owners of residential property located in the village the sum of an amount as set forth in § 35.02 for the owners’ voluntary installation of new sidewalk which replaces old sidewalk adjacent to such owners’ property, provided that prior to such reimbursement the Village Building Inspector must:
      (1)   Take measurements of the proposed sidewalk;
      (2)   Approve the materials and method of installation of the new sidewalk; and
      (3)   Issue a permit for the installation of the new sidewalk; and, provided that after completion of the new sidewalk, the Village Building Inspector must:
         (a)   Perform a final inspection;
         (b)   Approve the installation of the sidewalk, as completed; and
         (c)   Approve the request for reimbursement in writing.
   (B)   Voluntary commercial sidewalk reimbursement. Effective October 1, 2014, the village will reimburse commercial property owners an amount as set forth in § 35.02, for the owners’ voluntary installation of new sidewalk which replaces old sidewalk adjacent to such owners’ property; provided, that prior to such reimbursement the Village Inspector must:
      (1)   Take measurements of the proposed sidewalk;
      (2)   Approve the materials and method of installation of the new sidewalk; and
      (3)   Issue a permit for the installation of the new sidewalk and, provided that after completion of the new sidewalk, the Village Building Inspector must:
         (a)   Perform a final inspection;
         (b)   Approve the installation of the sidewalk, as completed; and
         (c)   Approve the request for reimbursement in writing.
   (C)   Mandated sidewalk replacement. Effective October l, 2014, when a property owner is mandated by the state or the village to replace sidewalk on the public right-of-way which lies adjacent to the owners’ property, the village will reimburse the property owner in an amount equal to 50% of the cost (inclusive of labor and materials) of the replacement of the old sidewalk; provided, however, that the village must approve a written cost estimate for any such sidewalk replacement prior to the commencement of installation of such replacement sidewalk, and provided that prior to such reimbursement the Village Inspector must:
      (1)   Take measurements of the proposed sidewalk;
      (2)   Approve the materials and method of installation of the new sidewalk; and
      (3)   Issue a permit for the installation of the new sidewalk; and, provided that after completion of the new sidewalk, the Village Building Inspector must:
         (a)   Perform a final inspection;
         (b)   Approve the installation of the sidewalk, as completed; and
         (c)   Approve the request for reimbursement in writing.
   (D)   Annual sidewalk reimbursement budget. Each year the Board of Trustees shall set a maximum amount to apply for to the sidewalk reimbursement program for that fiscal year, said amount to be set on or before the May meeting of the Village Board of Trustees. Property owners seeking reimbursement shall be paid in the order applications are received. Upon receipt of a request for reimbursement, a property owner shall be notified if there are not sufficient funds available for reimbursement that fiscal year, that owner shall still be entitled to reimbursement, but not until the start of the following fiscal year.
