(A) The town shall adopt, at least annually, an adequate schedule of user charges and surcharges, and tap fees to defray the cost of administering, operating and maintaining the sewerage system. The costs to be used as a basis for determining the charges shall include, but are not necessarily limited to, administration, direct operation and maintenance, collection and billing of charges, bond redemption, studies and reports, professional fees, user charges, surcharges and tap fees are to be used only for the purpose of administering, operating and maintaining the sewerage system and shall be published on a form for public distribution and notice.
(B) The Authority may allow users to discharge industrial wastes whose waste exceeds the limitations of § 51.020(C)(10), provided that the user discharging such waste shall agree to the payment of a surcharge to offset the entire cost incurred by the town in treating wastes containing five-day BOD, suspended solids or other waste constituents in excess of allowable limits. This surcharge shall be imposed in addition to any other charges made for sewer service.
