(A) This section shall apply only to that development which occurs in the subdivision of land along private streets and, furthermore, the development must comply with the provisions herein referred to in this section.
(B) Street design:
(1) For new lots being developed for someone other than family members, the property owner is required to pave an 18-foot wide road within a 35-foot right-of-way leading from the subdivision to a state-maintained road; and
(2) For lots developed for family members (defined as children, grandchildren, parents, grandparents or spouse) the following guidelines must be followed:
(a) For subdivisions created through an estate, a map must be created to record the subdivision and a 15-foot right-of-way must be dedicated up to the property to be subdivided and a 45-foot right-of-way within the estate property; and
(b) Subdivisions created by living persons for family members can be done in stages based on the number of lots involved:
1. For one to two lots, a 35-foot right-of-way is required to the nearest state-maintained road;
2. For three to five lots, an 18-foot wide graveled road is required within a 35-foot right-of-way up to the nearest state-maintained road. The road also must meet NCDOT design standards; and
3. For subdivisions with more than five lots, 18-foot wide paved roads which meet NCDOT design standards is required within a 35-foot right-of-way.
