§ 111.02 DEFINITIONS.
   For the purpose of this chapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning. When not inconsistent with the context, words used in the present tense include the future tense, words in the plural number include the singular number, and words in the singular number include the plural number. The word “shall” is always mandatory and not merely directory.
   CATV. Community antenna television.
   COMMUNITY ANTENNA TELEVISION SERVICE (CATV SERVICE). The business of furnishing any system, service or facility that, by means of a master antenna and wires or cables alone, receives, amplifies, modifies, transmits or distributes any television, radio or electronic signal, audio or video or both, to subscribing members of the public for compensation. It does not include providing master antenna services only to property owned or leased by the same person, firm or corporation, nor communication services rendered to a community antenna television service by a public utility that is regulated by the North Carolina Utilities Commission or the Federal Communications Commission in providing those services.
   FCC. The Federal Communications Commission.
   FRANCHISE. Includes any authorization granted hereunder in terms of franchise, privilege, permit, license or otherwise to construct or have constructed, operate and maintain a CATV system in the town.
   FRANCHISE AREAS. The total area of which a franchise is awarded by the Town Council.
   GRANTEE. The person, firm or corporation to whom or which a franchise, hereinabove defined, is granted by the Town Council under this chapter, and the lawful successor, transferee or assignee of said person, firm or corporation.
   GROSS SUBSCRIBER REVENUES. Includes regular basic subscriber service fees, installation fees received by the grantee as a result of the franchise granted hereunder with no deductions whatsoever and excluding any taxes imposed directly on any subscriber or user by and remitted to a governmental agency.
   PERSON. Any person, firm, partnership, association, corporation or organization of any kind.
   POTENTIAL SUBSCRIBERS. The households, commercial, industrial or institutional establishments within 200 feet from the cable where service could be provided for them. Any household which is not located within the 200-foot minimum distance shall be expected to share in any additional cost incurred by the CATV industry to run such lines.
   PROPERTY OF GRANTEE. All property owned and installed or used by a grantee in the conduct of a CATV business in the town under the authority of a franchise granted pursuant to this chapter.
   STREET. The surface of and the space above and below any publicly or privately owned or maintained property or right-of-way, street, road, highway, freeway, lane, path, alley, court, sidewalk, parkway or drive, now or hereafter existing as such within the town.
   SUBSCRIBER. Any person or entity receiving for any purpose the CATV service of a grantee.
   TOWN. The Town of Rutherford College.
   TOWN COUNCIL. The governing body of the Town of Rutherford College, North Carolina.
