§ 95.24 CURB CUTS.
   (A)   No person shall deface, damage or remove any part of any sidewalk, street or alley, pavement or any street sign, lamppost, gutter or curb, sewer drain, culvert, or any other appurtenance in any street unless authorized to do so by the city.
   (B)   Anyone desiring a curb cut or removal alteration or inclusion of any street appurtenance shall contact the Street Commissioner and file an application to ascertain the viability of said curb cut. Said persons shall also contact the Utilities Superintendent and file application to ascertain the viability of said curb cut.
   (C)   Curb cuts shall be allowed only with the permission of the Street Commissioner and shall comply with any requirements established by the Street Department and Utilities Superintendent.
   (D)   Any violation of this section shall result in a $100 fine per incident, plus the city may repair, remove or replace any curb or appurtenance damaged by failure to comply with this section, at the landowner's and/or contractor's expense by charging time and materials.
