§ 95.05 CERTAIN TREES PROHIBITED ON STREETS OR SIDEWALKS.
   (A)   North Carolina Poplar prohibited. It shall be unlawful to plant about or on any streets, the neutral zone, sidewalks, or other public places in the city any tree or trees known as North Carolina Poplars.

   (B)   Enforcement. It is the duty of the City Police Department and Street Commissioner to remove any trees planted as set out in division (A) above after giving the property owner of the ground upon which trees may be planted 24 hours notice to remove such trees.

   (C)   Exception. This chapter does not apply to any such trees growing at the time Ordinance No. 164 was adopted.

   (D)   Responsibilities of Street Commissioner. The city is not responsible for maintaining trees owner by landowners, nor any other tree which might be near or on the city’s right-of-way or located in a yard adjacent to the street. Any trees which affect the city’s maintenance of a roadway, alleyway, or street shall be removed or trimmed by the landowner to provide access for the city to maintain the right-of-way. The city shall provide 30-days' notice to the owner by any means available to the Street Commissioner or his duly appointed designees. Failure to remove or trim the affected trees after the 30-day period has expired shall result in the city charging expenses and costs to the landowner.
   (E)   Costs and expenses. Any trees which require immediate removal by the city because they are blocking a roadway, alleyway, or street shall be removed by the Street Department and the owner shall pay all costs and expenses associated with the clean-up.
