§ 94.03 PARK RULES AND REGULATIONS.
   (A)   All city parks shall have hours of use from 7:00 a.m. to 10:00 p.m. daily Monday through Sunday and no person or persons shall be in any city park outside of those hours unless the hereinafter described exceptions apply. If such person is in any city park during those hours he or she shall be in violation of this section.
   (B)   The following terms and conditions are exceptions to the above stated hours of use:
      (1)   Sponsored events which have been scheduled through the Parks and Recreation Department.
      (2)   Any person over the age of 18 years who is walking on the north and south Veterans Memorial Trail for exercise purposes or any person under the age of 18 years who is accompanied by a parent or legal guardian.
   (C)   There shall be no use of a metal detector(s) or shall be no digging allowed in any city park, with the exception of city personnel or utility company personnel.
   (D)   There shall be no smoking in any city park facility. Facility(ies) includes, but is not limited to, shelter houses, gazebo, restrooms, the Booker T. Washington Building, and the Riverside Park Amphitheater.
   (E)   For provisions regarding alcoholic beverages, see § 130.01.
   (F)   No person under the age of 18 shall be allowed to smoke anywhere in the city parks.
   (G)   No motorized vehicles, namely electric or gas powered scooters, cycles, go-carts, golf carts, trucks or cars are allowed in any city park with the exception of Parks Department trucks and equipment, police and emergency vehicles and motorized wheelchairs.
   (H)   Any person violating this section shall be issued a citation and:
      (1)   Fines or penalties for such citations shall be set as follows:
         (a)   First offense, $25.
         (b)   Second offense, $50.
         (c)   Third and subsequent offenses, $75.
         (d)   Fourth offense, $100.
         (e)   Fifth offense, and any offense thereafter, shall be fined in an amount not to exceed $500.
      (2)   Each time an officer responds shall constitute a new and separate offense. The fourth and subsequent offenses may be subject to court costs and legal fees, and also may be subject to community service work in the park.
      (3)   Any violation under $100 may be paid to the Ordinance Violations Bureau as described in this code. Any violation of $100 or more may be filed with the court by the City Attorney to enforce the matter.
