§ 52.99 PENALTY.
   (A)   Any person, firm or corporation violating any provisions of this chapter shall be fined in a sum not to exceed $2,500. Fines for the first offense shall be $100. Fines for the second offense shall be $1,500. Fines for the third offense shall be $2,500. Each day thereafter shall constitute a separate violation, which also will be fined at the sum of $2,500 per day. Each following or successive day shall constitute a separate violation, which will incur a separate fine of $2,500 per day.
   (B)   Additionally, any damages caused to a meter setting, meter pit, a hydrant, or other property owned by the utility shall be assessed against the consumer for costs associated with replacement, repairs, time and materials.
   (C)   Nothing contained in the penalty section herein shall preclude or prevent the city from pursuing criminal charges or any other remedy permissible under local, state or federal law.
   (D)   Any fines or other actions in violation of this chapter and/or the sanitary sewage ordinance, being Chapter 53 of this code, shall also include the possibility of termination of service by the Water Superintendent and the Board of Works.
   (E)   Any person who feels as though they have been aggrieved by the water utility or the Utility Superintendent’s decision shall request a hearing in writing within ten days of the Utility Superintendent’s action requesting a hearing before the Board of Works. The Board of Works may schedule the meeting at their next regularly scheduled meeting, or call a special meeting, if necessary.
   (F)   In order for service to be restored, all fines, costs, repairs and/or additional requirements of the Board of Works or the Utility Superintendent shall be completed prior to restoration of service.
   (G)   Any violation of this chapter and failure to comply with the Board’s rules, regulations and Superintendent’s orders may cause termination of services until the customer is compliant with this chapter.
