§ 35.03 REQUIREMENTS FOR RECEIPT OF CITY BENEFITS.
   (A)   From the date of passage of this section, only those parcels of property and related structures that are entirely situated within the city limits of Rushville shall be provided the benefits of being located within the city. Parcels of property and associated buildings that are entirely or partially located outside of the city limits shall not be provided the same benefits provided to parcels of property and structures located entirely within the city limits unless:
      (1)   The owner of record is willing to be annexed by the city and sign and execute documents to that effect; or
      (2)   The owner of record of the piece of property is willing to sign an agreement whereby the owner of record agrees to forbear from remonstrance in the event that the city attempts to annex the property.
   (B)   Upon satisfaction of one of the foregoing conditions, the City of Rushville will provide to that parcel of property and associated structures all the benefits associated with inclusion within the city limits.
