§ 34.61 LAW ENFORCEMENT CONTINUING EDUCATION FUND.
   (A)   Fund established; use. 
      (1)   A fund is established pursuant to I.C. 35-47-2-3, and states in part:
         ...(b) The law enforcement agency which accepts an application for a handgun license shall the following application fees:
         (1)   From a person applying for a four (4) year handgun license, a ten dollar ($10) application fee, five dollars ($5) of which shall be refunded if the license is not issued.
         (2)   From a person applying for a lifetime handgun license who does not currently possess a valid Indiana handgun license, a fifty dollar ($50) application fee, thirty dollars ($30) of which shall be refunded if the license is not issued.
         (3)   From a person applying for a lifetime handgun license who currently possesses a valid Indiana handgun license, a forty dollar ($40) application fee, thirty dollars ($30) of which shall be refunded if the license is not issued.
   The fee shall be deposited into the law enforcement agency’s ... fund; and used by the agency...
      (2)   There is hereby established a non-reverting firearms training fund and shall be under the control of the Chief of Police and is subject to the provisions of this section.

   (B)   Sources. The sources of this fund shall be provided exclusively by the monies received for handgun license applications. All monies received from applicants for handgun licenses shall be deposited therein.

   (C)   Limitation of fund. In keeping with the provisions of this chapter, the following procedures shall be followed in accounting for this fund:
      (1)   A receipt shall be issued, General Form No. 352, for each fee collected;
      (2)   Receipts shall be remitted to the Clerk-Treasurer at least once a month;
      (3)   The Clerk-Treasurer shall issue an official receipt for remittance specifying on such receipt the number of general receipts accounted for. (For example: General Receipt Nos. 1 - 8, $40.00.)
      (4)   The Clerk-Treasurer shall receipt the fees to a separate fund in the ledger of receipts and disbursements titled firearms training fund and deposit such receipts in the city's general corporation bank account.
      (5)   If the application for a handgun license is turned down, a refund shall be made from the firearms training fund without appropriation upon the basis of a claim filed, allowed and paid in the proper legal manner. No refunds for this purpose are to be made from any other fund of the city.
      (6)   All disbursement from the fund shall be used exclusively for the purpose of training law enforcement officers in the proper use of firearms or other law enforcement duties and made on the order of the Chief of the Police and payable by the Clerk-Treasurer upon presentation of proper claims, approved as other claims of the Police Department are approved.
      (7)   Monies from this fund may be invested by the Clerk-Treasurer and the interest shall be placed in the general operating fund.

   (D)   Fees. The following gun permit fees are hereby established:
      (1)   Unlimited license.
         (a)   Local fee $10
         (b)   State fee $15
      (2)   Target license.
