§ 32.03 ADVISORY PLAN COMMISSION AND ADVISORY BOARD OF ZONING APPEALS GENERAL PROVISIONS.
   (A)   Vacancies. Any vacancy on the Commission or the Board, occurring by resignation or otherwise, shall be filled by the authority or officer making the original appointment.
   (B)   Meetings. The Commission and Board created by this chapter shall fix the time for holding regular meetings, but shall each meet at least once in the month of January. Special meetings may be called by the President or by two members of the respective bodies upon written request to the Secretary and the Secretary shall send to all the members of the respective bodies, at least two business days in advance of a special meeting, a written notice, fixing the time and place of the meeting; provided that, such written notice of a special meeting shall not be required if the time of the special meeting has been fixed in a regular meeting or if all members are present at the special meeting. All meetings and records shall be governed by the Indiana Open Door Laws and the Indiana Public Records Laws.
   (C)   Quorum. A majority of the members of the Commission or Board created by this chapter shall constitute a quorum. No action of the Commission or Board shall be official unless authorized by a majority of the Commission or Board at a regular or properly called special meeting.
   (D)   Compensation. The members of the Plan Commission and Board may receive such salary, if any, as may be approved by the Common Council for service on the Commission or Board.
   (E)   Officers. At its first regular meeting in each year, the Commission and Board created by this chapter shall each select from their respective members a President and a Vice-President. The Commission and Board shall respectively also select a Secretary, which need not be a Board member.
   (F)   Employees. The Commission and Board may delegate operational and administrative duties to employees of any joint planning and zoning department created by and between Rushville, Rush County, and other municipalities within Rush County.
   (G)   Additional matters. In the event that any matter is not addressed or power, duty, or obligation specifically set forth herein with respect to the governance of the Commission or the Board, such matter or power, duty or obligation shall be governed by I.C. § 36-7-4, including all subparts, as amended.
   (H)   Ongoing matters. To the extent allowed by law, the Rushville Advisory Plan Commission and Board of Zoning Appeals shall assume responsibility for all ongoing planning and zoning matters within the corporate boundaries of the city that are pending before the Rush County Area Plan Commission or the Rush County Board of Zoning Appeals, that are under judicial review, or that are still ripe for potential judicial review or additional appeal on the effective date of this section.
