3-11-5: APPEAL FROM DENIAL OF LICENSE APPLICATION:
   A.   Within five (5) days, excluding weekends and legal holidays, from the refusal of the city clerk to issue a license under this chapter, the applicant for a license may appeal to the city council for the purpose of having the city council review the action of the city clerk.
   B.   The appeal by the applicant whose license has been refused must be in writing, and set forth in concise language the reasons such license should not have been refused.
   C.   The city council shall provide the applicant on appeal a due process hearing within fourteen (14) days, excluding weekends and legal holidays, after the filing thereof, and shall render its decision within seven (7) days, excluding weekends and legal holidays, after the said hearing. The decision of the majority of the city council shall be final as to the issuance of the license. (Ord. 726, 4-5-1994)
