§ 98.07 APPEAL.
   (A)   Any alarm system user who has been assessed a civil penalty under this chapter may request, orally or in writing, an informal hearing with the Police Chief or the Fire Chief. The decision of the Police Chief or Fire Chief may be appealed to the City Manager. In such a case, the notice of appeal shall be in writing and filed in the City Manager's Office within ten days of the issuance of a final decision by the Police Chief or Fire Chief. The City Manager shall schedule a hearing on the matter within 30 days from the date the notice of appeal is filed.
   (B)   Any alarm system owner who has been assessed a civil penalty under this chapter may appeal the assessment directly to the City Manager without first appearing before the Police Chief or Fire Chief. The notice of appeal shall be in writing and filed in the City Manager's office within ten days of the issuance of the assessment notice. The City Manager shall schedule a hearing on the matter within 30 days from the date the notice of appeal is filed. The decision of the City Manager shall be final.
   (C)   Failure to perfect an appeal within the time and in the manner provided for in this section shall constitute a waiver of the right to appeal.
