A. The total sale at retail of alcoholic beverages of a licensee shall be less than fifty percent (50%) of the applicant's total sales at retail of all products and services per calendar year at that site. This shall also apply to applications for special events permits. (Ord. 774, 12-4-2000; amd. 2012 Code)
B. The licensee shall have the burden of proof to show that it has complied with this fifty percent (50%) rule. The licensee shall produce such books and records required by the local liquor control commissioner for this purpose, see 235 Illinois Compiled Statutes 5/6-10.
C. The local liquor control commissioner may issue a new license to an applicant if the commissioner determines that, given the type of business, the applicant is likely to comply with this fifty percent (50%) rule during the license period. (Ord. 774, 12-4-2000)
