4-1-3: LOCAL LIQUOR CONTROL COMMISSIONER:
   A.   Village President Serve As: The village president shall serve as the local liquor control commissioner of the village and shall be charged with the administration of the provisions of the liquor control act, of this chapter and of such ordinances and resolutions relating to alcoholic liquor as may be enacted by the village. The village president, with the advice and consent of the board of trustees, may appoint a person or persons to assist him or her in the exercise of the powers and the performance of the duties provided for such local liquor control commissioner.
   B.   Compensation: The village president and village board of trustees may establish and pay compensation to the local liquor control commissioner. If the local liquor control commissioner is an elected official of the village, such compensation shall be considered as the compensation of that elected official and thus must be established prior to the term of that elected official as otherwise provided by law. The village president and village board of trustees may from time to time fix and pay compensation to the deputies, assistants or employees of the local liquor control commissioner as may be deemed necessary for the proper performance of the duties vested in them.
   C.   Powers, Duties And Functions: The local liquor control commissioner shall have the following powers, duties and functions with respect to local liquor licenses: (Ord. 774, 12-4-2000)
      1.   To impose a fine, assess costs, suspend for not more than thirty (30) days or revoke for cause, all local licenses issued to persons or entities for premises within his jurisdiction if he determines that the licensee has violated any provision of 235 Illinois Compiled Statutes or any valid village ordinance, rule or regulation established by him or the state liquor commission.       2.   To adopt rules and regulations for the conduct and operation of a licensee's business which are not inconsistent with state law or this code.
      3.   To enter or to authorize any law enforcing officer to enter at any time upon any premises licensed hereunder to determine whether any of the provisions of state law, this chapter or any rules or regulations adopted by him or by the state commission have been or are being violated, and at such time, to examine the premises of the licensee in connection therewith.
      4.   To receive complaints from any citizen within his jurisdiction that any of the provisions of state law, this chapter or any rules or regulations adopted by him have been or are being violated and to act upon such complaint in the manner provided by law.
      5.   To receive local license fees and pay the same forthwith to the village treasurer.
      6.   To examine, or cause to be examined, under oath, any applicant for a local license or for a renewal thereof, or any licensee upon whom notice of revocation or suspension has been served, and to examine, or cause to be examined, the books and records of any such applicant or licensee or respondent; and to hear testimony and take proof for his information in the performance of his duties and, for such purposes, to issue subpoenas which shall be effective in any part of the state. For the purpose of obtaining any of the information desired by the local liquor control commissioner under this subsection C6, he may authorize his agent to act on his behalf.
      7.   Without notice or hearing, to order, upon the issuance of a written order stating the reason for such conclusion, cause a licensed premises to be closed for not more than seven (7) days, giving the licensee an opportunity to be heard during that period, if the local liquor control commissioner has reason to believe that any continued operation of a particular licensed premises will immediately threaten the welfare of the community; except, that if such licensee shall also be engaged in the conduct of another business or businesses on the licensed premises, such order shall not be applicable to such other business or businesses.       8.   To notify the secretary of state where a club incorporated under the general not for profit corporation act of 1986 1 or a foreign corporation functioning as a club in the village under a certificate of authority issued under that act has violated this chapter by selling or offering for sale at retail alcoholic liquors without a retailer's license.
      9.   To notify the secretary of state of any convictions or dispositions of court supervision for a violation of 235 Illinois Compiled Statutes 5/6-20. (2012 Code)
