3-1-2: DISHONORED PAYMENTS:
   A.   Definition: For purposes of this section, the term "Village of Roxana" includes the Village of Roxana and each of its subdivisions, departments or commissions. (Ord. 764, 7-10-2000)
   B.   Fee:
      1.   Established: For each check, draft, money order, or similar form of payment which is returned to the Village as unpaid for the reason that the account is closed, insufficient funds, stopped payment or any other reason, there shall be assessed a fee of fifty dollars ($50.00) for each such financial instrument. This charge shall also apply to other invalid offers of payment to the Village, including, but not limited to, forged documents, unauthorized credit charges or invalid wire charges.       2.   Fee Is Additional: The fee set forth in subsection B1 of this section is cumulative to any other rates, fees, penalties and sanctions which are otherwise permitted by law. The fee is also in addition to any actual damages that may have been incurred by the Village arising from the financial transactions described in subsection C of this section. If a higher fee is allowed by State or Federal law, such higher fee shall, at the election of the Village, apply.
   C.   Penalties, Interest And Fees Apply: Any financial instrument which is returned as set forth in subsection B1 of this section shall be considered as if no payment had been made to the Village. Thus, any penalties, interest or fees which would have otherwise accrued shall continue to be calculated and added to the outstanding balance of such account. The Village may revoke any license or permit or discontinue any service that was paid by the returned check or other financial instrument. (Ord. 764, 7-10-2000)
