5-3-2: PROHIBITED BURNING:
   A.   It is unlawful for any person to cause or allow open burning, except as provided in this chapter. This prohibition on open burning includes, but is not limited to, the open burning of agricultural waste, clean wood building debris, domicile waste, garbage, household waste, landscape waste, municipal waste, refuse, solid waste, trade waste and waste.
   B.   The Illinois environmental protection agency has issued many regulations governing open burning (see, e.g., 35 Ill. adm. code part 237). These regulations prohibit open burning of agricultural wastes within the corporate limits of any municipality. The regulations also prohibit the burning of landscape waste within the St. Louis metropolitan area, including the village of Roxana. This chapter shall not permit any burning which is prohibited by the Illinois environmental agency with properly adopted rules. (Ord. 726, 12-21-1998)
