A. General Penalty Imposed:
1. Violation; Fine: The violation of or failure to comply with any provision of this code shall constitute an offense against the village, and where no specific penalty is provided therefor, each offense shall subject the offender, upon conviction, to a fine per day of, not less than one hundred dollars ($100.00) nor more than seven hundred fifty dollars ($750.00), per day, per offense.
2. Public Service: In addition to any other penalty or sanction available at law, the offender may be required to perform some reasonable public service work such as, but not limited to, the picking up of litter in public parks or along public highways or the maintenance of public facilities. This public service employment may be under the direction of the county probation department or other appropriate government or private agency that may be appropriate under the circumstances. Under appropriate circumstances, determined in an order of court, public service employment may be ordered instead of a fine or when a person is found to be financially unable to pay a fine.
3. Supervision: The judgment of the court imposing any penalty, fine, or fine and the cost of prosecution, may also include an order of supervision of the defendant in compliance with the criminal code of the state of Illinois including, but not limited to, the provisions of 730 Illinois Compiled Statutes 5/5-4.5-75.
4. Nuisance Declared: Any condition caused or permitted to exist in violation of any of the provisions of this code or any ordinance of the village shall be deemed a public nuisance and shall be subject to abatement by the village.
5. Each Act A Separate Violation: Each and every act, action or thing done in violation of the provisions of this code, or ordinance of the village, shall be construed, deemed and taken as a separate and distinct violation of such provisions of this code, and in every event that a violation of this code, or any of the provisions hereof, shall continue, each day of such continuance shall be deemed, construed, and taken as a separate and distinct violation of the provisions of this code.
B. Limitation; Compliance With Statute: The provisions of subsection A of this section notwithstanding, no penalty shall be greater than that established by state statute for the same offense.
