(A) Upon receipt of an application and permit fee for a permit to hold an outdoor mass gathering, the Board shall require that the organizer obtain the approval of the organizer’s plan by the State Police (or the County Sheriff’s Department, if the MSP declines to review the Plan), the village’s Fire Chief, or his or her designated agent, and the District No. 10 Health Official before the permit is finally approved by the Board.
(B) If there are questions about the approval by any such entities of the organizer’s plan, the Board may direct a representative thereof to communicate with such third-party reviewing agency to address any such question. The Board may, in addition, request comment on the application from any other third- party reviewing agency or official who, in the Board’s opinion, may be affected, or whose comments might assist the Village Board.
(C) The Board shall consider such application for an outdoor mass gathering permit and shall grant the same if it:
(1) Demonstrates compliance with, or the ability to comply with, the administrative rules of the appropriate county/state regulatory agencies, State Police, and the Fire Chief of the district in which the mass gathering is to be held;
(2) Demonstrates that the proposed outdoor mass gathering will not make any permanent physical alterations to, or on, the real property which is the site of the outdoor mass gathering (except for permanent physical alterations that have been, or will be, approved pursuant to the village’s zoning permit processes), or materially alter the capability to use the real property upon which the outdoor mass gathering is to be held in the future for uses designated under the real property’s Comprehensive Plan and zoning designation;
(3) Demonstrates compliance with, or the ability to comply with, the requirements of the State Liquor Commission, if alcohol will be served and, if applicable, the Village Police Department;
(4) Demonstrates that the proposed outdoor mass gathering will not disturb persons or property in the vicinity of the gathering for reasons such as, but not limited to, excessive noise, dust, drunkenness, or trespassing. In all cases, outdoor amplified sound shall cease by 2:00 a.m., unless a later time is approved by the Village Board; and
(5) Demonstrates that the proposed outdoor mass gathering complies with, and is permitted and approved by, the Department of Environment, Great Lakes, and Energy (EGLE), or other entity having jurisdiction over camping.
