§ 33.020  CELL PHONE USAGE.
   All town employees, whether operating a commercial motor vehicle, operating a town vehicle, and/or operating a personal vehicle while conducting town business, shall adhere to all federal regulations regarding the use of a cell phone. Specifically, all town employees, whether operating a commercial motor vehicle, operating a town vehicle, and/or operating a personal vehicle, shall refrain from using a cell phone to place calls, receive calls, place a text, and/or receive a text, except as provided herein. A town employee may use a cell phone if such use is hands-free by using a wired or wireless earpiece, the speakerphone function of the cell phone, and/or the hands-free function of a phone built into the vehicle. A town employee may initiate, answer, or terminate a call by touching a single button on a mobile telephone, earpiece, steering wheel, or instrument panel. These regulations shall not restrict or prohibit a town employee from using a cell phone in emergency situations.
