(A) The Town Street Department, Town Council, and town (collectively the town) specify that mailboxes should be located so that the face of the mailbox is at least six inches behind the line where the street meets the curb, or, if there is no curb present, at least six inches behind the edge of the street. Mailboxes should be located so that the bottom of the mailbox is at least 41 inches from the ground.
(B) If a property owner locates a mailbox according to the specifications of division (A) above and the mailbox is damaged by the town while removing snow or performing street maintenance or repairs, the town shall be responsible for the repair and/or replacement of the mailbox and/or post in an amount not exceeding $25.
(C) If a property owner does not locate a mailbox according to the specifications of division (A) above and the mailbox is damaged by the town while removing snow or performing street maintenance or repairs, the town shall not be responsible for the repair or replacement of the mailbox and/or post.
(D) The town, regardless of the circumstances or cause, shall not be responsible for repairing or replacing any mailbox that is found to be in an unsound or unusable condition.
(E) The town shall not be responsible for providing repair or replacement of basketball goals, posts, poles, decorative items, or any items other than mailboxes and mailbox posts, that may be damaged by the town while removing snow or performing street maintenance or repairs.
(F) The town shall not be responsible for providing or maintaining approaches to mailboxes.
