931.02 RESPONSE ACTIONS AND RESPONSE COSTS.
   (a)   The City shall take appropriate response actions in the event of a spill, release, or unauthorized discharge of material into or upon the environment within the City and any other areas for which the City has responsibility for emergency management activities. To the extent feasible and appropriate, the City shall use prescribed methods for response actions.
   (b)   The Fire Chief, Police Chief and Public Works Director shall ensure that a detailed record of all response costs is kept. Response costs shall include the replacement cost of all expendable equipment and materials used and the repair or replacement cost of all other equipment that is used and damaged. Response costs shall also include the reasonable hourly cost of use of personnel and City vehicles used in the response action. These hourly costs shall be established by ordinance.
   (c)   Upon the completion of a response action, the Fire Chief, Police Chief, and Public Works Director shall promptly provide a detailed record of response costs to the Municipal Administrator and the Law Director. The Law Director shall then seek to recover the response costs in accordance with the procedures established by Ohio Revised Code 3745.13.
