707.01 PROHIBITED OPERATIONS; NUISANCE.
   (a)   No person, firm or corporation shall conduct any commercial dredging operations in waters within the territorial limits of the City under the following conditions:
      (1)   On Saturdays, Sundays, legal holidays or on other days before 8:00 a.m. or after 4:30 p.m.;
      (2)   At any time, within 500 feet of the shore line of the east bank or within 500 feet of any shore of any island of the Maumee River;
      (3)   At an time or at any place where the effect of such operation is to cause the erosion of the natural shoreline of any part of the bank of the Maumee River or of any island; or cause the undermining or weakening of any bulkhead, piling, riprap, retaining wall, dock, breakwater or bridge within the territorial limits of the City.
   (b)   No person, firm or corporation shall, in the conduct of any commercial dredging operation in waters within the territorial limits of the City:
      (1)   Cause the escape, concentration or increase of any substance harmful or deleterious to plant or animal life in the waters or on any abutting shoreline;
      (2)   Increase the turbidity of the waters, measured at a time not less than two hours after any period during which the dredging equipment was working, at or downstream of the place where such dredging was conducted.
   (c)   Any violation of this section is hereby deemed a public nuisance.
