3-1-10: RESTRICTIONS INVOLVING UNDERAGE PERSON(S):
   A.   No Sale To Underage Person(s): No licensee, his or her agent or employee shall serve or dispense upon the licensed premises any intoxicating liquor or 3.2 percent malt liquors to a person under the legal drinking age; nor shall such licensee, or his or her agent or employee, permit any such person to be furnished or consume any such liquors on the licensed premises; nor shall such licensee, his or her agent or employee, permit any such person to be delivered any such liquors.
   B.   Delivery To Underage Person(s): No person under the legal drinking age shall receive delivery of intoxicating or 3.2 percent malt liquor.
   C.   Misrepresenting Age: No person under the legal drinking age shall misrepresent his or her age for the purpose of obtaining intoxicating liquor or 3.2 percent malt liquor, nor shall he or she enter any premises licensed for the retail sale of intoxicating liquor or 3.2 percent malt liquor for the purpose of purchasing or having served or delivered to him or her for consuming any such intoxicating liquor or beer, nor shall any such person purchase, attempt to purchase, consume or have another person purchase for him any intoxicating liquor or 3.2 percent malt liquor.
   D.   Identification Required: Any person shall, upon demand of the licensee, his or her employee or agent, produce and permit to be examined a current driver's license or photo identification issued by the state department of public safety. In the case of a foreign national, a valid passport may be used as an alternative to the foregoing methods of identification.
   E.   Compliance Checks: From time to time, the city shall conduct compliance checks. Such checks may involve, but are not limited to, engaging underage persons to enter the licensed premises to attempt to purchase alcoholic beverages. (Ord. 2015-06, 7-7-2015; Ord. 2021-05, 10-5-2021)
