7-1-3: OBSCENE MATERIALS; SALE AND POSSESSION:
   A.   Definitions: As used in this section:
    DISTRIBUTE: To transfer possession, whether with or without consideration.
   KNOWINGLY: Being aware of the character of the matter or live conduct.
   MATTER: Any book, magazine, newspaper or other printed or written material or any picture, drawing, photograph, motion picture or other pictorial representation or any statue or other figure, or any recording, transcription or mechanical, chemical or electrical reproduction or any other articles, equipment, machines or materials.
   OBSCENE: That which to the average person applying contemporary community standards appeals to the prurient interest and taken as a whole lacks serious literary, artistic, political or scientific value and is:
      1.   A patently offensive representation or description of ultimate sexual acts, normal or perverted, actual or simulated, or
      2.   A patently offensive representation or description of masturbation, excretory functions and lewd exhibition of the genitals.
   PERSON: Any individual, partnership, firm, association, corporation or other legal entity. (Ord. XV.2, 7-20-1976)
   B.   Violation; Penalty: Every person who knowingly sends or causes to be sent, or brings or causes to be brought, into this city for sale or distribution, or in this city prepares, publishes, prints, exhibits, distributes or offers to distribute, or has in his possession with intent to distribute or to exhibit or offer to distribute, any obscene matter, is guilty of a misdemeanor and upon conviction thereof shall be punished as described in title 1, chapter 4 of this code. Such violation shall be grounds for revocation or suspension of any and all licenses held at such premises. (Ord. XII.21, 6-15-2004)
