§ 154.013 INTERPRETATION, PURPOSE, AND CONFLICT.
   (A)   G.S. Ch. 160D is applicable to this chapter. In the event of any conflict between this chapter and G.S. Ch. 160D, the provisions of G.S. Ch. 160D shall control.
   (B)   Application of certain terms.
      (1)   “Written” or “in writing” is deemed to include electronic documentation.
      (2)   Unless specified otherwise, in the absence of evidence to the contrary, delivery by first-class mail shall be deemed received on the third business day following deposit of the item for mailing with the United States Postal Service, and delivery by electronic mail shall be deemed received on the date sent.
   (C)   In interpreting and applying the provisions of this chapter, they shall be held to be the minimum requirements for the promotion of the public safety, health, convenience, prosperity, and general welfare. It is not intended by this chapter to interfere with, abrogate, or annul any easements, covenants, or other agreements between parties; provided, however, that where this chapter imposes a greater restriction upon the use of buildings or premises or upon the height of buildings, or requires larger open spaces than are imposed or required by other ordinances, rules, regulations, or by easements, covenants, or agreements, the provisions of this chapter shall govern. The Zoning Ordinance of 1957, plus amendments, and the Ordinance Governing Mobile Home and Mobile Parks in the Town of Rose Hill, North Carolina of 1968, are hereby repealed; however, nothing in this new Zoning Ordinance shall be constructed to amend or repeal any other existing ordinances.
