§ 52.01 REFUSE COLLECTION.
   (A)   Generally. The special regulations set forth below apply to the preparation of garbage, trash, yard debris, and recyclable materials for collection.
   (B)   Specifically.
      (1)   A single-family residence shall have one roll cart container provided by the town for storage of garbage during the interval between collections by the town. Additional containers may be added where the residence so warrants; advance approval of the Public Works Director or his or her designee is required. Any additional container must be obtained through the town to ensure compatibility with the towns' collection equipment.
      (2)   It shall be unlawful for any owner, occupant, or tenant to deposit, or permit to be deposited, any garbage arising from the use of the premises in any place other than on the premises and in any container other than the receptacle hereby required to be maintained. It shall be unlawful for the owner or user to permit the garbage receptacle to remain uncovered.
      (3)   If the number of containers necessary to service a unit, apartment building, mobile home park, commercial operation, industrial operation, or any multiple-family dwelling complex, exceeds three in number, the Public Works Director may require the use of one or more large containers (dumpsters). The dumpsters or containers are to be at the expense of the user.
      (4)   Large containers (dumpsters) shall be made of metal and shall be of a size, shape, and design to handle collection equipment.
      (5)   Trash shall be placed in the roll out cart and placed behind the curb. Trash will be placed in one location so as to permit only one stop at each location.
      (6)   Yard debris will be bagged, packaged, or otherwise containerized for collection. It may be placed in a roll out container but may not be combined with garbage. Yard debris which is too large for containerization will be stacked or piled neatly behind the curbline or roadway edge at a location which is accessible to collection equipment. The bulk collection does not include leaves, grass clippings, or pine straw which must be containerized for collection.
      (7)   Each residence shall have one recycling container provided by the town for storage of recyclable materials during the interval between collections. However, some commercial units may be provided with a cardboard trailer for their collections.
      (8)   Roll-out refuse containers and recyclable containers shall be placed behind the curbline or roadway edge of the property for collection, (commercial unit's location must be approved the Public Works Director or his or her designee) no earlier than the evening before scheduled collections and no later than 7:00 a.m. on the day of collection. Containers shall be retrieved and returned to the dwelling by the end of the collection day. It is the intent of this section to minimize the aesthetic disruption resulting from permanently locating carts at the curbside for extended periods of time.
      (9)   All containers shall be maintained in good condition. Damaged containers will be replaced by the town at no cost to the resident, except that damage which was caused as a result of the misuse or abuse by the users or others will be the responsibility of the user.
      (10)   All containers are the property of the town and are assigned per user. Containers will be imprinted with a control number for tracking. In the event a unit is vacated, the container shall remain with the residence or be returned to the town for reuse. If a user fails to return the container, the cost of replacement will be the property owner's responsibility (i.e., water deposit and ad valorem taxes).
