§ 32.30 REMOVAL AND REMEDIAL ACTION.
   The village and the Department shall have the authority to take all removal and remedial action necessary to respond to a release or substantial threat of a release of hazardous substances within the corporate limits of the village, and to take all removal and remedial action required or permitted under the terms of a mutual aid agreement or similar intergovernmental agreement with one or more units of local government. In the event of the occurrence of a release or a substantial threat of a release of hazardous substances which the village and the Department may remove or remediate pursuant to this subchapter, the Chief of the Department or his designee shall have the authority to determine the necessity for removal or remedial action, the form and manner of such removal and remedial action, to utilize all available resources and personnel to effectuate such removal and remedial action, and to otherwise direct and control the conduct of all removal or remedial action taken until such time as any appropriate state or federal agency having jurisdiction over the release or substantial threat of a release of hazardous substances asserts such jurisdiction over said release or substantial threat of release, and the removal and remediation thereof, or until such time as all necessary removal and remedial action has been completed in accordance with applicable state or federal statutes or regulations.
