   (C)   Motor vehicle incident response cost recovery fees. The following charges shall be imposed upon parties requesting, served by or otherwise responsible for calls for the following listed Fire Department response services involving a motor vehicle incident:
      (1)   Level 1 - Hazardous materials assessment and scene stabilization. $478.50 per incident.
      (2)   Level 2 - Includes Level 1 services as well as any required clean up and material used (sorbents) for hazardous fluid clean up and disposal. $544.50 per incident.
      (3)   Level 3 - Vehicle fires. Provide scene safety, fire suppression, breathing air, rescue tools, hand tools, hose, tip use, foam, structure protection, and clean up gasoline or other automotive fluids that are spilled as a result of the accident/incident. $665.50 per incident.
      (4)   Level 4 - Includes Level 1 and 2 services as well as extrication from vehicles requiring the use of any equipment (heavy rescue tools, ropes, airbags, cribbing etc.). $1,980.00 per incident.
      (5)   Level 5 - Includes Levels 1, 2, and 4 services involving multiple engine company responses or mutual aid agreement responses, or incidents requiring airborne patient transportation. $2,420.00 per incident.
      (6)   Extraction rescue/recovery services. In addition, any of the foregoing levels of motor vehicle incident response that require extrication rescue/recovery services shall be charged an additional fee of $375 per person so extricated. As used herein, "extrication rescue/ recovery services" shall mean and include services relating to or involving the removal of a person from a vehicle involved in a motor vehicle collision or other accident where specialized extrication tools are used, or where a person extricated is required to be immobilized on a backboard or other comparable device.
   (D)   Ambulance transport fees for residents and non-residents. The following charges shall be imposed upon both resident and non-resident parties requesting, served by or otherwise responsible for calls for the following listed ambulance transport services, and except as otherwise indicated, are imposed on a one-way basis for transportation from the location where the call for ambulance service is requested to a hospital.
      (1)   Basis for calculation of ambulance transport fees. As of January 1 of any given year, the basis for ambulance transport fees charged by the Village Fire Department during the year in question shall be the costs set forth in the most recent annual report then on file with the Illinois Department of Healthcare and Family Services (HFS) and/or the Federal Centers for Medicare and Medicaid Services (the "Annual Report"), reflecting the actual cost incurred for the transport of persons by ambulance, whether resident or nonresident. All persons transported by ambulance shall be charged ambulance fees equal to the cost for such transport as listed in the Annual Report, together with a mileage fee equal to the distance traveled to transport the patient to the hospital at $15 per mile.
      (2)   Any resident or non-resident refusing transport but requiring basic life support ("BLS") on scene shall be charged $50 for the third and each subsequent on-scene BLS service within a given calendar year. BLS is defined as care involving the treatment of non-life threatening injuries or illnesses, requiring only basic levels of care.
      (3)   Any resident or non-resident refusing transport but requiring advanced life support ("ALS") on scene shall be charged $100. ALS is defined as care involving the use of advanced medical procedures, including but not limited to the administration of medication, intravenous therapy, and electrocardiogram testing and interpretation.
   (E)   Hazmat incident response fees. The following charges shall be imposed upon parties requesting, served by or otherwise responsible for calls for the following listed Fire Department response services involving a hazmat incident. The fees and charges set forth in this division (E) shall represent and include the minimum removal and remedial action cost for village and Fire Department response to a hazardous material incident for which a party may be held liable pursuant to the provisions of § 32.28. Nothing herein shall be deemed to limit the village's right and ability under said § 32.28 to recover its actual removal and remedial action costs incurred in response to a hazardous material incident even if such costs exceed the fees and charges set forth in this division (E), or the village's right and ability to recover other fees and charges as set forth in this chapter.
      (1)   Level 1 - Basic response. Includes engine response, first responder assignment, perimeter establishment, evacuations, set-up and command. $700, based on an assumed one hour response by an engine company.
      (2)   Level 2 - Intermediate response. Includes engine response, first responder assignment, hazmat certified team and appropriate equipment, perimeter establishment, evacuations, set-up and command, Level A or B suit donning, breathing air and detection equipment. Set-up and removal of decontamination center. $2,500, based on an assumed two hour response by an engine company and hazmat response team.
      (3)   Level 3 - Advanced response. Includes engine response, first responder assignment, hazmat certified team and appropriate equipment, perimeter establishment, evacuations, first responder set-up and command, Level A or B suit donning, breathing air and detection equipment and robot deployment. Set-up and removal of decontamination center, detection equipment, recovery and identification of material. $5,900, based on an assumed three hour on-scene response by an engine company and Department hazmat team. Includes basic disposal and clean-up services performed by responding Department hazmat teams, but does not include costs incurred by the responding Department hazmat teams for materials used and third party disposal and clean up services required in connection with the response, which will be billed in addition on a pass-through basis.
      (4)   Additional response time charges. In the event that Department personnel or equipment is required on-scene in connection with a response to a given hazardous material incident in excess of the response times included and assumed within the above response levels, the minimum hourly charges for such response time shall be as set forth below:
         (a)   Hazmat team      $300 per hour per team
         (b)   Engine company   $400 per hour
         (c)   Truck company   $500 per hour
         (d)    Additional/other equipment   $300 per hour
         (e)   Materials and services from third party providers. Billed on a pass through basis.
   (F)   Pipeline/power line incident response fees. The following charges shall be imposed upon parties requesting, served by or otherwise responsible for calls for the following listed Fire Department response services involving a pipeline/power line incident. The fees and charges set forth in this division (F) shall represent and include the minimum removal and remedial action cost for village and Fire Department response to a pipeline/power line incident for which a party may be held liable pursuant to the provisions of § 32.28. Nothing herein shall be deemed to limit the village's right and ability under said § 32.28 to recover its actual removal and remedial action costs incurred in response to a hazardous material incident even if such costs exceed the fees and charges set forth in this division (F), or the village's right and ability to recover other fees and charges as set forth in this chapter.
      (1)   Level 1 - Basic response. Includes engine response, first responder assignment, perimeter establishment, evacuations, set-up and command, and inspections, where no damage to or breakage of pipeline/power line facilities is involved. $400, based on an assumed one hour response.
      (2)   Level 2 - Intermediate response. Includes engine response, first responder assignment, perimeter establishment, evacuations, set-up and command, and may include, as required, hazmat team response, Level A or B suit donning, breathing apparatus donning and deployment of detection equipment, supervision and/or assistance of damaged pipeline/power line repair. $1,000, based on an assumed two hour response.
      (3)   Level 3 - Advanced response. Includes engine response, first responder assignment, perimeter establishment, evacuations, set-up and command, and may include, as required, hazmat team response, Level A or B suit donning, breathing apparatus donning and deployment of detection equipment, supervision and/or assistance of intermediate to major pipeline/power line repair, set up and removal of decontamination center, and the detection, recovery, identification, cleanup and disposal of materials. Does not include costs incurred by the responding Department hazmat teams for materials used and third party disposal and clean up services required in connection with the response, which will be billed in addition on a pass-through basis. Variable fee based on actual response time spent by personnel and equipment in responding to incident.
      (4)   Additional response time charges. In the event that Department personnel or equipment is required on-scene in connection with a response to a given pipeline/power line incident in excess of the response times included and assumed within the above response levels, the minimum hourly charges for such response time shall be as set forth below. These charges, as well as all other actual costs incurred, may also be used in calculating the fee for a Level 3 advanced response to a pipeline/power line incident:
         (a)   Hazmat team      $300 per hour per team
         (b)   Engine company   $400 per hour
         (c)   Truck company   $500 per hour
         (d)    Additional/other equipment   $300 per hour
         (e)   Materials and services from third party providers. Billed on a pass through basis.
   (G)   Fire investigation fee. The following charges shall be imposed upon parties requesting, served by or otherwise responsible for calls for the following listed Fire Department response services involving a fire investigation. Includes response to a fire by Department investigative team to assess scene safety, investigate fire, identify fire source, use of Arson dog/K-9 units as appropriate, identification equipment, mobile detection units, and preparation of fire report. $275 per hour logged. Notwithstanding the foregoing, the fire investigation fee shall not be applicable to or charged with respect to fire investigations or calls for the other services listed hereinabove with respect to fires or incidents involving owner-occupied single-family residential property.
   (H)   Water incident response fee. The following charges shall be imposed upon parties requesting, served by or otherwise responsible for calls for the following listed Fire Department response services involving a water incident. The fees and charges set forth in this division (H) shall represent and include the minimum removal and remedial action cost for village and Fire Department response to a pipeline/power line incident for which a party may be held liable pursuant to the provisions of § 32.28. Nothing herein shall be deemed to limit the village's right and ability under said § 32.28 to recover its actual removal and remedial action costs incurred in response to a hazardous material incident even if such costs exceed the fees and charges set forth in this division (H), or the village's right and ability to recover other fees and charges as set forth in this chapter.
      (1)   Level 1 - Basic response. Includes engine response, first responder assignment, perimeter establishment, evacuations, first responder set-up and command, scene safety and investigation (including possible patient contact, hazard control). $400, based on an assumed one hour response, plus $50 per hour for each rescue responder deployed to the incident.
      (2)   Level 2 - Intermediate response. Includes Level 1 services, clean up services, use of sorbents, minor hazmat clean up and disposal services. $800, based on an assumed two hour response, plus $50 per hour for each rescue responder deployed to the incident.
      (3)   Level 3 - Advanced response. Includes Level 1 and Level 2 services, dive and rescue team activation, donning breathing apparatus, deployment of detection equipment, recovery and identification of material. Does not include costs incurred for materials used and third party disposal and clean up services required in connection with the response, which will be billed in addition on a pass-through basis. $2,000, based on an assumed three hour response, plus $50 per hour for each rescue responder deployed to the incident, plus $100 per hour for any hazmat team member deployed to the incident.
      (4)   Additional response time charges. In the event that Department personnel or equipment is required on-scene in connection with a response to a given water incident in excess of the response times included and assumed within the above response levels, the minimum hourly charges for such response time shall be as set forth below.
         (a)   Hazmat team      $300 per hour per team
         (b)   Engine company   $400 per hour
         (c)   Truck company   $500 per hour
         (d)    Additional/other equipment   $300 per hour
         (e)   Materials and services from third party providers. Billed on a pass through basis.
   (I)   Back country/special rescue fees; technical rescue service fees.
      (1)   The following charges shall be imposed for calls for the following listed Fire Department response services involving a back country or special rescue. Includes services provided in response to requests for rescues from wilderness areas, canyons/ravines, holes/shafts, underground areas, and other locations or circumstances not otherwise addressed in this section but which require the Department to respond with trained rescue personnel or specialized equipment. Fee will be calculated based on a rate of $400 per hour for the initial response vehicle and $70 per hour for each rescue team member deployed. Additional vehicles and rescue personnel deployed in response to such an incident will be billed at the same hourly rates. Costs incurred for materials or services will be billed on a pass through basis.
      (2)   The following charges shall be imposed for Fire Department provision of technical rescue services as hereinafter defined, where the Department is required to respond with trained rescue personnel or specialized equipment. Fee will be calculated based on a rate of $400 per hour for the initial response vehicle and $70 per hour for each rescue team member deployed. Additional vehicles and rescue personnel deployed in response to such an incident will be billed at the same hourly rates. Costs incurred for materials or services will be billed on a pass through basis. As used herein, "technical rescue services" means and includes emergency rescue or response services involving high angle rescue/recovery, confined space rescue/recovery, structural collapse rescue/recovery, underwater/submerged rescue/recovery or vehicle/machinery rescue/recovery.
      (3)   The following listed categories of persons shall be jointly and severally liable for the provision of any response services set forth in this division (I):
         (a)   Owners of vehicles at which such response services are provided;
         (b)   Any and all persons involved in activities contributing to or responsible for the need for such response services;
         (c)   Owners or possessors of any property to which or for the benefit of which such response services were provided;
         (d)   Individuals for whom such rescue services are provided, and any persons responsible for the need of such individuals to receive such response services; and
         (e)   Individuals responsible for the creation of any conditions resulting in the need for such response services to be provided.
   (J)   Chief response. The following charges shall be imposed upon parties requesting, served by or otherwise responsible for calls for the following listed Fire Department response services that necessitate the presence of or on-scene command by the Department Chief or a Department Assistant Chief. Includes response to any incident by the Chief or any Assistant Chief, establishment of command, and directing response to an incident. $250 per hour.
   (K)   Late/unpaid invoices. Unpaid balances of invoices for fees and charges due and owing under this section that are not paid within 30 days of the date of the invoice shall, to the extent permitted by applicable law, bear interest at a rate of 1.5% per month. Thereafter, unpaid balances of invoices for fees and charges due and owing under this section that are not paid within 90 days of the date of the invoice shall incur a penalty equal to 10% of the unpaid amount, and may be referred to the Fire Department's collections services provider.
