§ 36.02 APPOINTMENT OF COMMISSIONERS; INITIAL TERMS; QUALIFICATIONS.
   (A)   Members of the Town Economic Development Commission shall be appointed by the President of the Town Council in the following manner:
      (1)   One of the members shall be selected by the President of the Town Council;
      (2)   One member shall be nominated by the County Council; and
      (3)   One member shall be nominated by the Town Council.
   (B)   The nominations made by the County Council and the Town Council shall be transmitted to the Town Council President in writing within ten days from August 3, 1976.
   (C)   No person shall be appointed as a Commissioner who is not either a resident of the town, employed in the town, or an owner of a business in the town.
   (D)   If any Commissioner shall cease to qualify in one of the above categories, his or her appointment on the Commission shall thereby terminate, and his or her office shall become vacant.
   (E)   The Commissioners shall take office upon their appointment and their terms shall run the following numbers of years from February 1, 1977, following their original appointment: the Commissioner selected by the President of the Town Council shall serve for three years; the Commissioner nominated by the Town Council shall serve for two years; and the Commissioner nominated by the County Council shall serve for one year.
   (F)   Each Commissioner, before entering upon his or her duties, shall take and subscribe an oath of office in the usual form, to be endorsed upon a certificate of his or her appointment, which shall be promptly filed with the Clerk-Treasurer of the town.
