(A)   The Town Council finds it necessary to establish a failure to substantially complete fee in an effort to reduce the number of buildings that are left unfinished once construction has been started.
      (1)   The town will aggressively take legal action against those in violation.
      (2)   The fees are as follows:
         (a)   Residential: $100 per day after permitted date of substantial completion;
         (b)   Commercial: $250 per day; and
         (c)   Industrial: $500 per day.
      (3)   Substantial completion is defined as: structure is closed in with roof, windows, doors, exterior finished, rough electric, plumbing and mechanical completed; interior walls in place with drywall/plaster applied; finish/trim out work is exempt from this definition.
   (B)   Lot improvement is expected to be completed within one year of the structures substantial completion date. It is established that a fee of $50 per day be charged to the property owner for each day the lot remains unimproved.
