All operators of tattoo or body-piercing establishments shall comply with the following training responsibilities:
(A) Ensure that the training described in the State Occupational Safety and Health Administration’s bloodborne pathogens standard is provided to all tattoo artists and body piercers, anyone employed by the tattoo or body-piercing establishment or anyone acting on behalf of the tattoo or body-piercing establishment who has a reasonably anticipated risk for skin, eye, mucous membrane or parental contact with blood or OPIM;
(B) Ensure that training on the handling of infectious waste is provided to all tattoo artists and body piercers, anyone employed by the tattoo or body-piercing establishment who has a reasonably anticipated risk for skin, eye, mucous membrane or parental contact with blood or OPIM;
(C) Ensure that a record of training described in division (A) above is maintained, as required under the State Occupational Safety and Health Administration’s bloodborne pathogens standard of an individual’s participation in the training that is provided. The record shall be made available for inspection upon request by the Board, or its duly authorized agent or designee; and
(D) Ensure that a record of training described in division (B) above is maintained.
